Gilbert's has a proven track record of resolving difficult cases creatively. We obtained funding for amateur hockey among women and in underprivileged communities by challenging the NHL's rights to the Stanley Cup. We negotiated a deal on behalf of the Province of Ontario in a significant waste dispute with the State of Michigan. We successfully represented the underdog in two of North America's largest cross-border patent infringement cases in the last five years.

Counsel to Cobalt Pharmaceuticals in Patented Medicines (Notice of Compliance) proceedings involving the relationship between an enantiomer selection patent and Cobalt's repaglinide product to treat diabetes - Federal Court decided in favour of Cobalt, granting Cobalt regulatory approval to sell repaglinide (Cobalt was the first generic manufacturer in Canada to receive marketing approval)
Lundbeck Canada Inc. v. Cobalt Pharmaceuticals Inc. et al.
Counsel to Cobalt Pharmaceuticals in a judicial review application regarding the Alzheimer's drug, memantine - Federal Court of Appeal affirmed decision that Cobalt's product was eligible for abbreviated approval
Janssen-Ortho Inc. et al. v. Mylan Pharmaceuticals ULC et al.
Counsel to Mylan Pharmaceuticals in Patented Medicines (Notice of Compliance) proceedings involving the relationship between a dosage regimen patent and Mylan's first-to-file extended-release galantamine product to treat Alzheimer's - Federal Court decided in favour of Mylan, granting Mylan regulatory approval to sell galantamine (Mylan was the first independent generic manufacturer in Canada to receive marketing approval)
Research in Motion Limited v. Visto Corporation
Counsel to Visto Corporation in patent infringement litigation in Federal Court of Canada regarding wireless "push technology" and synchronization patents, and in a $100 million Ontario lawsuit by RIM under the Competition Act and Trade-Marks Act - these actions were settled as part of a global settlement resulting in a $267.5 million payment to Visto Corporation
Datatreasury Corporation v. Royal Bank of Canada et al.
Counsel to Datatreasury Corporation in patent infringement and impeachment litigation in Federal Court of Canada against the Canada's six largest banks and their service providers, regarding cheque imaging computer systems allowing secure remote capture, central storage and verification - the action was settled on confidential terms in September 2010, prior to trial
Seroquel Class Action Litigation
Representing AstraZeneca in significant product liability class actions commenced in Ontario, Quebec, Alberta, and British Columbia; to date, we have successfully defeated authorization (i.e., certification) in Quebec
Ritz-Carlton Grand Cayman Litigation
Representing Michael Ryan, a leading developer in Grand Cayman and Ontario, in breach of contract actions in the Ontario Superior Court relating to construction of the Ritz-Carlton hotel
Touchpoint v. Cineplex Entertainment LP et al.
Representing Cineplex and Famous Players in action for over $2 million for alleged breach of contract, negligent and fraudulent misrepresentation
Stanley Cup Challenge Application
Represented the applicants in an unusual proceeding challenging the National Hockey League's apparent exclusive control over the Stanley Cup; acting pro bono, Gilbert's reached a very favourable settlement for its clients, and the National Hockey League agreed to pay $500,000 over 5 years to support amateur hockey among women and in underprivileged communities
Paul Abbott v. Prime Data Group Inc. and James R. Frye
Successfully represented Mr. Abbott in breach of employment contract litigation resulting in a summary judgment order for the entire claim
iSkin Inc. v. Shuang Sa et al.
Resisted an injunction and obtained dismissal of action against zCover in a trade secret, passing off, trade-mark and industrial design infringement action involving iPod skins
Eli Lilly Canada Inc. et al. v. Sandoz Canada Inc.
Represented ScinoPharm Taiwan Limited (supplier of anti-cancer drug, gemcitabine, to Sandoz) in patent infringement proceedings relating to chemical process patents - ScinoPharm and Eli Lilly settled global patent litigation (including Taiwan, United Kingdom, Australia) in 2009

We also know that, to the extent possible, clients want no surprises as a matter moves forward.
To make our relationship with clients as fulfilling as possible, we offer the following client relationship management (CRM) services in association with our services:

  • Client relationship manager: Continuity of care is important in all professions, and the legal profession is no exception. We ensure that clients have a direct line to a client relationship manager, whose role is to ensure that all aspects of client files - from initial budgeting to trial - are proceeding smoothly in accordance with client needs and expectations.
  • Legal project management: From the outset of each project, Gilbert's will prepare a budget mapping out the likely scenarios to be faced as proceedings move forward, and anticipating risks that may lead to variations to the budget to arrive at a critical path to success. The critical path - involving strategy, personnel and budget allocation - is reviewed over the duration of the client file and is adapted to meet changing client needs. We provide monthly updates, or updates as requested, regarding the critical path and ensure timely discussion regarding potential changes.
  • Sortable, task-based account management: In addition to providing typical invoices for services, Gilbert's offers sortable, task-based invoices that allow clients to track precisely how Gilbert's lawyers have been spending their time. Tasks are organized according to the life of a file and are integrated in the critical path for easy review by the client.

Tim is an able and experienced trial advocate and has represented clients in various courts and forums in a variety of areas. He is known and respected in the commercial courts of Ontario and the Federal Court of Canada and has broad experience in intellectual property litigation in several leading industries, including the pharmaceutical, high-tech and financial services industries.

Tim has significant experience in pharmaceutical regulatory law effectively representing clients concerning all aspects of the administrative process affecting the manufacture and sale of pharmaceutical products in both Canada and the United States. This has included counsel on issues of bioequivalence of drug products, internal appeals from administrative decisions, judicial review of these decisions and the eligibility of products for inclusion in provincial drug formularies.
\rTim also has experience in competition law representing clients in open matters now under consideration before the Competition Bureau and the U.S. Federal Trade Commission.

At Gilbert's LLP, we do things a little differently. We offer a friendly, diverse and dynamic work environment. A student at Gilbert's will be exposed to intellectual property, litigation, policy and government relations and regulatory and administrative law. We're not a big firm, but we do attract big firm work.

Community

Gilbert's is actively involved in the community in three primary ways: through its pro bono initiative, through scholarships and bursaries that it awards to Canadian universities and colleges, and through its international aid projects.

Scholarships and Bursaries

Gilbert's LLP was founded on a philosophy that it is important to maintain ongoing contact with the academic world and institutions of higher learning.

Through the Gilbert's student program, we participate in and support various events at North American universities.

In 2002, Gilbert's established the Gilbert's Law Ontario Graduate Scholarship at the College of Arts of the University of Guelph. This endowment will provide an annual award of approximately $15,000 to fund graduate research into areas that include the ethical and legal implications of scientific research and development.

Gilbert's LLP annually donates to Sheridan Institute of Technology and Advanced learning to award the "Gilbert's LLP Prize in Design Thinking" to students with the highest final marks in Sheridan's "Design Thinking" courses.

Gilbert's LLP also has a history of working with university professors and students to develop academic scholarship that achieves real-world impact, through publication in peer-reviewed journals, implementation of creative government policy, and development of new business models.

International Aid / Africa

Gilbert's LLP is committed to pro bono work extending beyond the borders of Ontario.

In addition to its work with Gilbert's Global, Gilbert's assisted the nation of Ghana in studying how Canada's "Jean Chrétien Pledge to Africa Act" could help developing countries obtain compulsory licenses for still-patented medicines. Gilbert's gave a presentation on implementing the Act to health officials from the Government of Ghana in September 2004, and has provided submissions to both the Intellectual Property Institute of Canada, and directly to Parliament, on addressing problems with the Act's regulations.

Gilbert's is coordinating its effort with the University of Toronto and private foundations in the United States.

Pro Bono

Gilbert's LLP aggressively pursues pro bono work. The firm's commitment to pro bono work is a direct result of the members' belief that membership in the bar requires a commitment to serving members of society barred from justice on the basis of cost alone.



We spend approximately ten percent of our time on pro bono work, exceeding the standards of the American Bar Association's Law Firm Pro Bono Challenge, which challenges law firms to dedicate at least three percent of their billable hours to pro bono work.
